Welcome to KidStarter, an online fundraising platform that allows parents to raise funds from family and friends for their child's custodial savings, 529 college plans, and investment accounts. Please read these terms of service carefully before using our platform.

1. Acceptance of Terms

By accessing or using KidStarter, you agree to be bound by these terms of service. If you do not agree to these terms, you may not use our platform.

2. Use of Platform

You must be at least 18 years of age or have the permission of a parent or legal guardian to use KidStarter. You agree to use our platform for lawful purposes only, and not to engage in any activity that violates any applicable law, regulation, or these terms of service. You are solely responsible for the content you upload to our platform and agree not to post any content that is infringing, defamatory, offensive, or illegal.

3. Fundraising Campaigns

KidStarter allows parents to create fundraising campaigns to raise funds for their child's custodial savings, 529 college plans, and investment accounts. By creating a fundraising campaign on KidStarter, you represent and warrant that you have the legal right to do so and that all information provided is true and accurate. You agree not to create any fraudulent, misleading, or deceptive campaigns.

4. Payments and Fees

KidStarter uses a third-party payment processor to handle all payments made through our platform. By using our platform, you agree to comply with the terms and conditions of our payment processor. You acknowledge and agree that KidStarter charges a platform fee for each donation made to a fundraising campaign, which is used to cover the costs of operating our platform.

5. Refunds

All donations made through KidStarter are final and non-refundable. However, in the event of any technical issues or errors, please contact us at support@mykidstarter.com and we will do our best to resolve the issue.

6. Intellectual Property

KidStarter and its content, including but not limited to text, graphics, logos, images, and software, are the property of KidStarter or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, or distribute any content from KidStarter without our prior written consent.

7. Disclaimer of Warranties

KidStarter provides its platform “as is” and without any warranty or condition, express, implied, or statutory. We do not warrant that our platform will be uninterrupted, error-free, or secure, and we disclaim all warranties of any kind, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

8. Limitation of Liability

In no event shall KidStarter be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of our platform or inability to use our platform.

9. Indemnification

You agree to indemnify and hold KidStarter and its officers, directors, employees, and agents harmless from any claim, demand, or damages, including attorneys’ fees, arising out of your use of our platform, your violation of these terms of service, or your violation of any third-party rights.

10. Modifications

KidStarter reserves the right to modify these terms of service at any time without prior notice. Any changes to these terms will be posted on our website and will be effective immediately upon posting. Your continued use of our platform after the modifications have been made will constitute your acceptance of the revised terms of service.

11. Termination

KidStarter may terminate your access to our platform at any time, without notice, for any reason, including but not limited to your violation of these terms of service. Upon termination, you must cease all use of our platform and delete any content you have uploaded.

12. Dispute Resolution

Any dispute arising out of or relating to these terms of service or your use of KidStarter shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The prevailing party shall be entitled to recover its reasonable attorneys' fees and costs.

13. Entire Agreement

These terms of service constitute the entire agreement between you and KidStarter and govern your use of our platform, superseding any prior agreements between you and KidStarter. If any provision of these terms of service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
